Terms of Service

By accessing or using LumiChats ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you may not access or use the Platform.

These Terms apply to all users of LumiChats, including visitors, registered users, and paying subscribers. We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

If you are using LumiChats on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

LumiChats is a pay-per-use AI platform that provides access to large language models and AI-powered tools including, but not limited to, conversational AI, study assistance, agent mode, and document analysis.

The Platform is intended for educational, creative, and professional productivity purposes. We offer access to third-party AI models provided by Anthropic, OpenAI, Google, and others. LumiChats acts as an intermediary and does not own or train the underlying AI models.

Service availability, features, and pricing are subject to change. We will make reasonable efforts to notify users of significant changes in advance.

You must be at least 13 years of age to use LumiChats. Users under the age of 18 must have parental or guardian consent.

You are required to provide accurate, current, and complete information when creating an account. The use of disposable, temporary, or throwaway email addresses for account registration is strictly prohibited. Accounts created using such email services may be suspended without notice and without refund.

You are responsible for maintaining the security of your account credentials. You may not share your account with others or allow others to access the Platform using your credentials.

We reserve the right to verify account information at any time. Accounts that cannot be verified, or that are found to contain false or misleading information, may be suspended or permanently terminated at our sole discretion.

You may not create multiple accounts for the purpose of circumventing restrictions, bans, or payment requirements.

You agree to use LumiChats only for lawful purposes and in a manner that does not infringe the rights of others. The following uses are strictly prohibited and constitute grounds for immediate account termination.

Identity and Privacy Violations: You may not use LumiChats to generate, create, or distribute AI content — including images, text, audio, or any other media — that depicts, impersonates, or is based on a real, identifiable person without that person's explicit, verifiable consent. This includes generating realistic likenesses of individuals, fabricating quotes or statements attributed to real people, or creating content designed to be mistaken for genuine content produced by or about a real individual.

Sharing another person's personal information, social media profiles, or private data with the intent to use AI tools to target, replicate, or harm that person is strictly forbidden. LumiChats considers this a serious violation regardless of the stated intent.

Harmful and Illegal Content: You may not use the Platform to generate content that is defamatory, harassing, threatening, sexually explicit, or otherwise harmful. You may not use the Platform to facilitate illegal activities, fraud, phishing, or any form of cybercrime.

Platform Integrity: You may not use automated scripts, bots, or other programmatic means to access the Platform without prior written authorisation. You may not attempt to reverse-engineer, scrape, or circumvent any security measures or rate limits.

Misrepresentation: You may not misrepresent your identity, location, or the purpose of your account. You may not use VPNs, proxy servers, or other tools to bypass geographic or account-level restrictions.

LumiChats reserves the right to determine, at its sole discretion, whether any use of the Platform violates this Acceptable Use Policy. Such determinations are final.

LumiChats provides access to AI language models as a tool. The Platform does not create, curate, or endorse the content generated through user interactions with these models.

You are solely responsible for all content you input into the Platform and all content generated by the AI in response to your prompts. You acknowledge that AI-generated content may sometimes be inaccurate, incomplete, offensive, or otherwise unsuitable for your intended purpose.

LumiChats is not liable for any harm, loss, or damage arising from your use of AI-generated content. This includes professional, legal, medical, or financial decisions made based on AI outputs.

You agree not to represent AI-generated content as your own original work in contexts where such representation is deceptive or prohibited.

We actively monitor usage patterns for potential policy violations. Where content generation is flagged as potentially harmful or in violation of these Terms, we reserve the right to suspend access immediately and without prior notice.

LumiChats operates on a pay-per-use model. Fees are charged in advance for the selected access period at the rates displayed at the time of purchase.

All payments are processed through third-party payment providers including Razorpay and Stripe. By making a payment, you agree to the terms of the relevant payment processor. LumiChats does not store your full payment card details.

Refunds are issued at our sole discretion. However, in the event that an account is suspended or terminated due to a Terms of Service violation identified by our review process, we will issue a full refund of any payment made. This refund does not constitute an admission of liability, nor does it limit our right to take further action where necessary.

Where a refund is issued, the associated account will be permanently closed and the registration email and payment method may be flagged to prevent re-registration.

Chargebacks initiated without first contacting our support team may result in permanent account suspension and referral to our payment processor's fraud review team.

LumiChats reserves the right to suspend, restrict, or permanently terminate any account at any time, for any reason, with or without prior notice. Reasons may include violation of these Terms, suspicious account activity, use of unverifiable credentials, or behaviour that we determine in good faith to be harmful to other users, third parties, or the integrity of the Platform.

In cases where an account is terminated due to a policy violation: access to the Platform is revoked immediately; the associated email address and known registration methods may be permanently blacklisted; any active subscription will be cancelled; and a refund may be issued at our discretion.

You may appeal a suspension by contacting us at lumichats@gmail.com with valid government-issued identification for identity verification. We will review genuine appeals within seven business days. We reserve the right to uphold the termination where we reasonably believe a violation has occurred.

LumiChats publicly documents significant policy enforcement actions in aggregate and anonymised form as part of our commitment to transparency. No personally identifiable information of terminated users is shared publicly.

The LumiChats platform, including its design, code, branding, and all original content produced by us, is the intellectual property of LumiChats and its founders. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without prior written permission.

You retain ownership of the content you input into the Platform. By using LumiChats, you grant us a limited, non-exclusive licence to process your inputs solely for the purpose of providing the service to you.

AI-generated outputs produced through your use of the Platform are not guaranteed to be free from third-party intellectual property claims. It is your responsibility to assess and comply with applicable intellectual property laws when using or distributing AI-generated content.

To the fullest extent permitted by applicable law, LumiChats and its founders, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components.

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the total amount paid by you to LumiChats in the twelve months preceding the claim.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached informally, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

For users in the European Union, you may also have the right to lodge a complaint with your local data protection authority.
